Terms & Conditions

These Terms & Conditions ("Terms") are between you and Danny Wilson ("we", "us", the "Seller"), the operator of Quote Now..Win Now (the "Service"). By creating an account or continuing to use the Service, you agree to these Terms. If you use the Service on behalf of a business, you confirm you have authority to bind that business; if you use it as an individual, you confirm you are of legal age in your jurisdiction.

1. The Service

Quote Now..Win Now is an estimating tool for contractors (landscaping, irrigation, plumbing and general trades). It lets you build estimates with line items, generate AI-assisted drafts, share estimates with your clients for approval and signature, and manage clients and business details.

2. Accounts

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• AI-generated estimate drafts are suggestions only. You are responsible for reviewing prices, quantities and scope before sending an estimate to a client.

3. Acceptable use

You must not misuse the Service, including:

• Using it for any unlawful purpose, fraud, or spam;
• Infringing intellectual property rights of others;
• Introducing malware, probing or scanning for vulnerabilities, or scraping the Service;
• Reverse engineering, reselling, redistributing, or circumventing technical limits of the Service.

4. Intellectual property

We retain all ownership of the Service and its intellectual property, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan. You retain ownership of the content you create (estimates, client data); you grant us a limited license to host and process that content solely to provide the Service.

5. Subscription, billing and payments

The Service is offered as a monthly subscription (currently $29/month) with a 14-day free trial for new accounts. Payment, billing, tax, cancellation and refund mechanics are handled by our payment provider and are governed by Paddle's Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

6. Service level

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.

7. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time via the Paddle customer portal or by contacting us. When your access ends, your data may be deleted after a reasonable period; export anything you need beforehand.

8. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months before the claim, and we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill). Nothing in these Terms excludes liability for fraud, death or personal injury where the law does not allow it. Estimates you send are your responsibility — we are not liable for pricing errors in your quotes.

9. General

• These Terms are governed by the laws of the United States and the state where the Seller is based, and disputes will be resolved in the courts of that jurisdiction.
• You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition.
• We are not liable for delays caused by events beyond our reasonable control.
• We may update these Terms; continued use of the Service after changes means you accept them.
